Fence Regulations
FENCE REGULATIONS
PUBLISHED BY AUTHORITY
Pursuant to the authority conferred by Section 180 of the Municipalities Act, SNL 1999 Chapter M-24, the Town Council of North West River has made the following regulations.
These regulations may be cited as "The Town of North West River Fencing Regulations, 2022".
1. Interpretation of these regulations, unless the context otherwise requires:
a) "Act" means the Municipalities Act, Chapter M-24, 1999 as amended.
b) "Council" means the Town Council of North West River.
c) "Property Owner" means any person, firm or corporation who wishes to construct a fence on his/her/their property.
d) "Municipality" means the Town of North West River.
e) "Clerk" means the Town Clerk/Manager of the Town of North West River
2. Any property owner wishing to construct a fence within the municipality of North West River must obtain a permit. Prior to obtaining a permit, an application must be filed, and the prescribed fee paid to the clerk. All construction must comply with the Town of North West River Fencing Regulation 2022 as sited below.

a) All fences must be set back a minimum of 15 feet from the edge of the pavement.
b) Any fence of privacy picket or wire mesh must not exceed 2.4 metres in height.
c) Any fence of lateral cross bars shall consist of no more than three (3) lateral cross bars and one (1) vertical fence post at least 2.4 metres apart and shall be no more than 1.3 metres in height.
4. Existing fences which are in contravention of these regulations shall not be repaired or replaced by the property owner except in a manner which conforms to these regulations, unless approved at the discretion of council. The property owner of any existing fence which contravenes with these regulations may be required by council to remove any portion of the fence which, in the opinion of council, constitutes an impediment to snow removal activities. Such modification shall be done before the start of the snow removal activities. Such modifications shall be done before the snow removal season (November 1st April 1st) and remain in effect throughout the season.
5. Every person who neglects, contravenes, or fails to comply with any provisions of these regulations shall be guilty of an offence and shall be liable on summary conviction of a fine not exceeding one thousand dollars ($1000.00) or in default of payment of such fine to imprisonment for a period not exceeding ninety (90) days, or both a fine and imprisonment, in accordance with the Municipalities Act, Chapter M-24, Section 420, 1999 as amended.
These regulations were adopted by the resolution of council #MOTION 2022-07-04-008 on July 4th, 2022 and shall take effect on the 4th day of July, 2022.
All previous Fencing Regulations are hereby repealed.
